Welcome to Better Mood, a service published by P Society (« we », « our », « us »). These Terms of Service (« ToS ») are intended to define the terms and conditions of access and use of Better Mood (the « Service »). By accessing or using the Service, you (« the User ») fully and unreservedly accept these ToS.

1. Legal information

2. Service purpose

Better Mood is a SaaS platform developed by P Society allowing users to track their daily mood and receive personalized emotional analysis through artificial intelligence. P Society makes its best efforts to provide a quality Service, but does not guarantee that the Service will be free from errors, bugs or interruptions.

The Service uses third-party artificial intelligence services to analyze user messages. As part of this process, data may be temporarily transmitted to these providers for processing. The analyses produced by the AI may contain errors or inaccuracies and do not replace human or professional interpretation.

The Service is reserved for persons aged 16 and over, in accordance with the General Data Protection Regulation (GDPR).

3. Service access

Access to the Service may require the creation of a user account. The User undertakes to provide accurate information and to keep it up to date.

  • Credentials (email, password) are strictly personal and confidential
  • Any fraudulent or abusive use may result in account suspension or deletion by P Society
  • The User is responsible for any activity carried out with their credentials

4. Subscriptions and financial conditions

Use of the Service may be:

  • Free with limitations (1 AI analysis per day, limited access to history), or
  • Subject to a paid subscription (monthly or annual) for extended access (2 to 5 analyses per day, full history, temporal patterns)

Current pricing is available directly on the Better Mood website.

In case of paid subscription:

  • Prices are expressed in US dollars (USD) and may be modified at any time
  • Payments are made exclusively via Stripe
  • Subscriptions automatically renew at expiry, unless terminated by the User
  • No refund will be granted, except for mandatory legal provisions
  • Access to the Service is suspended in case of non-payment

Right of withdrawal

In accordance with article L.221-28 of the Consumer Code, the consumer User acknowledges and accepts that they lose their right of withdrawal as soon as the execution of the Service begins before the expiration of the legal withdrawal period of 14 days.

5. Intellectual property

All elements of the Service (software, interfaces, texts, images, logos, trademarks, databases, API, algorithms) are protected by current legislation and remain the exclusive property of P Society or its partners.

  • The User has only a personal, non-exclusive and non-transferable right of use
  • Any reproduction, modification, distribution or exploitation without written authorization is prohibited

6. User-generated content

Better Mood allows users to keep a daily mood journal and receive emotional analysis. Users may publish content including:

  • Mood journal entries (daily messages describing their emotions)
  • Emotional data (mood level, energy, stress)
  • Personal preferences and settings
  • AI-generated content during analyses (insights, recommendations, quotes)

Rules and restrictions:

  • The User remains the owner of their content, but grants P Society a worldwide, free, non-exclusive license to host, store, reproduce and distribute this content within the framework of the Service
  • The User guarantees that they have the necessary rights to the published content and that it does not violate the law or third-party rights
  • The following content is strictly prohibited:
  • Explicit sexual or pornographic content
  • Violent, hateful or discriminatory content
  • Defamatory, slanderous or threatening content
  • Content inciting violence, self-harm or suicide
  • Copyright-protected content without authorization
  • Spam, unauthorized advertising or commercial content
  • Attempts to circumvent service limitations (analysis quotas)
  • Abusive or fraudulent use of AI analysis features

P Society reserves the right to moderate, suspend or delete any content deemed inappropriate or illegal, as well as to suspend or delete user accounts in case of repeated violation of these rules.

7. Responsibilities

IMPORTANT WARNING: Better Mood is a personal tracking and wellness tool, and does NOT replace medical treatment, therapy or the advice of a mental health professional. If you experience psychological distress, suicidal thoughts or any other serious mental health issue, please contact a healthcare professional immediately or call an emergency number (988 in the US, 3114 in France).

P Society's responsibility:

  • The Service is provided « as is », without express or implied warranty
  • We are not responsible for indirect damages such as data loss, loss of business, business interruption or commercial prejudice
  • AI analyses provided are informative and do not constitute a medical or psychological diagnosis

User's responsibility:

  • The User is solely responsible for their use of the Service and the data they introduce
  • They guarantee P Society against any claim related to this use

8. Personal data

P Society collects and processes personal data solely to ensure the functioning of the Service, in accordance with GDPR.

9. Usage limits

Better Mood applies usage limits to ensure service quality:

  • Free plan: 1 AI analysis per day, limited access to the last 3 history entries
  • Deep Insight plan: 2 AI analyses per day, full history, emotion and keyword analyses
  • Life Journey plan: 5 AI analyses per day, full history, advanced temporal patterns
  • Limits may be modified at any time with prior notification
  • Abusive use of the service may result in temporary or permanent account suspension

10. Termination

The User may terminate their account at any time, either from their profile settings (if available) or by contacting P Society at contact.nukloop@gmail.com

  • Termination of a paid subscription takes effect at the end of the current billing period
  • P Society reserves the right to suspend or delete an account in case of violation of these ToS
  • In case of termination, personal data is deleted within 30 days
  • Mood entries and analyses created may be kept for technical reasons for a maximum of 90 days
  • Mood and analysis data may be retained in anonymized form for statistical purposes after account deletion

11. Force majeure

P Society cannot be held responsible for any delay or failure in the execution of its obligations resulting from circumstances beyond its control, including:

  • Server or infrastructure failures
  • Service interruptions from providers (Vercel, Stripe, etc.)
  • Natural disasters, social conflicts, or political events
  • Regulatory changes affecting the service

12. Applicable law and jurisdiction

These ToS are governed by French law, to the exclusion of any other legislation. In case of dispute, the parties will endeavor to find an amicable solution. Failing this, French courts will have sole jurisdiction.

In the event of translation of these ToS, only the French version shall prevail.

13. ToS modifications

P Society reserves the right to modify these ToS at any time. Modifications will take effect upon their publication on the site. Continued use of the Service after modification constitutes acceptance of the new conditions.

  • Users will be notified of important modifications by email
  • The last update date is indicated at the top of this document
  • In case of disagreement with the new conditions, the user may terminate their account
